Dispute Resolution Leading litigation expertise across Norwegian and international courts
Berngaard's dispute resolution team has leading litigation expertise and broad experience from proceedings before both Norwegian and international courts, as well as arbitration cases. Our litigation specialists work closely with other practice groups and assist across a wide range of legal areas – from large, complex disputes to matters of smaller scope.
We focus on efficient dispute resolution grounded in rigorous litigation risk assessments – combining deep procedural expertise with legal and commercial evaluations of the issues at stake. This analysis also provides a solid basis for assessing the financial considerations in negotiations compared to full court proceedings.
We regularly assist with dispute resolution outside the courts, and have strong experience in identifying approaches that improve the prospects of a favourable outcome in such processes.
The team is led by Marius Emberland, one of Norway's leading litigators. Emberland has a background from the Office of the Attorney General, the Court of Appeal and the Ministry of Justice, and holds rights of audience before the Supreme Court of Norway. He has litigated around 15 cases before the country's highest court – several in Grand Chamber and in plenary – and has represented the Norwegian government before both the EFTA Court and the Court of Justice of the European Union (CJEU). He was also part of the state's legal team in the first bilateral investment treaty arbitration against Norway, from 2021 to 2023.
